A disputed signature on a personal guarantee

How do you distinguish the borrower’s signature from the guarantor’s on the same form?

Legal document examination / Forensic handwriting and documents in legal disputes

A loan form may have separate fields for the borrower, guarantor and witness. Mark the disputed field on a working copy and record its label and page. Retain the complete form as received, its attachments and the message enclosing it. A signature in the borrower’s box does not by itself identify who signed the guarantor’s box.

If the guarantee amount or the time it was entered is disputed, frame that as a separate question. Handwriting comparison can address who wrote a signature. By itself it cannot establish the figure on the form at signing or the terms accepted. Look for a copy delivered at the time and a record of its delivery.

Tzion Bahalul, attorney and notary

A disputed signature on a contract, will or payment instruction raises two distinct questions: what can be learned from the document, and what legal steps are available. Tzion Bahalul & Co. handles the legal dispute, including civil fraud claims and recovery of funds in Israel.
